Contemporary Issues Derived from The Hadeeth’s of Beautification and Going Out to Eid Prayer
الملخص
The Sunnah is the second origin on which the Faqih is based on in deducing the rulings from its shari'a evidence. Therefore, the Hadith's relationship with the shari'a rulings is an origin to a branch relationship. The shari'a rulings are derived only from the text of the Holy Quran or a Sunnah, either by text or analogy, so, the relationship between the Sunnah and the Shari'a rulings can not be bypassed or overlooked. The Prophet did not leave the interest of the life and the lifeafter but warned or pointed to it. Therefore, the prophetic Hadiths, which are the basis of the rulings, and the scholars rely on them, are of the best where the efforts to be made in studying and considering them. Through this study, the researcher tries to root out the studied Hadiths in accordance with the contemporary social changes and jurisprudential through: Listing discrepancies of jurists. - Studying their evidences- Discussing the evidences. - Knowing cause of the discrepancy- Weighting. In addition to searching for the jurisprudential rules on the issue which have an impact on the judgment. I have chosen for this study a collection of Hadiths of the book of Eid from the Book of “Almotabaqqi Fi Alahkam Alshar’ia Fi Kalam Khair Albaryya “ By Sheikh Abi Al Barakat Majd al-Din Abdul Salam bin Abdullah bin Abi Qasim bin Taymiyah. Study Approach: Is a descriptive, inductive, and deductive methodology by dividing each.
السنّة هي الأصل الثاني الذي يستند إليه الفقيه في استنباط الأحكام من أدلتها الشرعية، ولذلك فإنّ ارتباط الحديث النبوي بالأحكام الشرعية ارتباط الأصل بالفرع؛ وذلك أنّ الأحكام الشرعية لا تستنبط إلا من النص كتابا أو سنة، - نصا أو قياسا - وعليهما يدور الإجماع وبقية الأدلة الشرعية، ولهذا فإنّ الآصرة بين السنة والأحكام الشرعية آصرة لا يمكن تجاوزها ولا إغفالها. ولم يترك النبي r مصلحة دنيوية ولا أخروية إلا نبه عليها أو أشار إليها، فلم يترك خيرا إلا دلّ النّاس كافة عليه، ولا شرا إلا حذرهم ونبههم من الوقوع فيه. ولذلك فإنّ الأحاديث النبوية التي ترجع أصول الأحكام إليها، ويعتمد العلماء عليها من خير ما يُبذل الوسع والجهد في دراسته والنظر فيه. وتحاول الباحثة من خلال هذه الدراسة تأصيل الأحاديث المدروسة تأصيلا فقهيا وفق التغيرات الاجتماعية المعاصرة، والنوازل الفقهية الواقعة، وذلك من خلال: حصر اختلافات الفقهاء ودراسة أدلتهم، ومناقشة الأدلة، ومعرفة سبب الخلاف والترجيح، بالإضافة للبحث عن القواعد الفقهية المتعلقة بالمسألة والتي لها أثر في الحكم عليها. وقد اخترتُ لهذه الدراسة مجموعة من أحاديث كتاب العيد من كتاب "المنتقى في الأحكام الشرعية من كلام خير البرية r" للشيخ أبي البركات مجد الدين عبد السلام بن عبد الله بن أبي القاسم بن تيمية. أما منهجُ الدراسة فهو المنهج الوصفي والاستقرائي الاستنباطي.
